§ 1 General Provisions – Scope of Application
- These General Terms and Conditions ("Terms") apply to all orders and contractual relationships between horntools International GmbH, Grabenstrasse 11D, 6340 Baar, Switzerland – hereinafter referred to as "horntools" – and its customers via the online shop horntools.ch. The version valid at the time the contract is concluded shall apply.
- Consumers are natural persons who purchase goods predominantly for private purposes. Businesses are natural or legal persons, or partnerships, who act in the exercise of their trade, business, or profession when concluding the contract.
- Any terms and conditions of the customer that deviate from, conflict with, or supplement these Terms shall only become part of the contract if horntools has expressly agreed to their applicability.
- By placing an order, the customer agrees to these Terms, provided they were made reasonably accessible to the customer prior to completion of the order.
§ 2 Conclusion of the Contract
- The presentation of products in the online shop serves to showcase our range and does not, in principle, constitute a binding offer to conclude a contract.
- By submitting the order, the customer makes a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
- Before submitting the order in a binding manner, the customer can review and correct their entries.
- Receipt of the order is confirmed immediately by electronic means. The automatic order confirmation initially merely documents receipt of the order and does not yet constitute acceptance of the contractual offer, unless acceptance is expressly declared therein.
- The contract is concluded as soon as horntools expressly confirms the order, sends a shipping confirmation, or ships the ordered goods.
- horntools is entitled to reject an order, in particular in the event of unavailability of the goods, obviously incorrect price information, reasonable suspicion of misuse, or failed payment processing.
- Any payments already made will be refunded in the event of rejection of the order or unavailability of the goods.
- horntools may limit order quantities to amounts customary for household use.
- The text of the contract and the order data are stored within the framework of legal and technical possibilities. The customer receives the essential order data by e-mail.
§ 3 Contract Language
The online shop and contract information may be made available in several languages. In principle, the version used during the ordering process shall be authoritative. In the event of discrepancies between translations, the German version shall serve as the reference version, to the extent legally permissible.
§ 4 Retention of Title
To the extent legally permissible, the delivered goods shall remain the property of horntools until full payment of all claims arising from the respective purchase contract. To the extent that registration in a public register is required under Swiss law for a retention of title to be effective, such registration remains reserved.
Businesses may only resell goods subject to retention of title in the ordinary course of business.
§ 5 Voluntary Right of Return
horntools voluntarily grants private end consumers a 14-day right of return.
Details, requirements, exclusions, and information on return shipping costs are set out in our Return Policy.
The voluntary right of return is distinct from statutory claims for defective or faulty goods and does not limit such claims.
§ 6 Prices and Payment
- The prices listed in the online shop for consumers are quoted in Swiss francs (CHF) and include the statutory public charges and Swiss VAT, where applicable.
- Any additional shipping costs incurred are displayed transparently before the order is completed.
- For deliveries via horntools.ch within Switzerland, the shipping and customs conditions stated at checkout and in the shipping conditions shall apply.
- The total price displayed at checkout at the time of ordering shall be binding for the respective order. Subsequent price changes shall have no effect on contracts already concluded.
- Depending on availability, the following payment methods may be offered, among others:
- Credit card (Visa, Mastercard)
- TWINT
- Advance payment
- PayPal
- Google Pay
- In the case of payment by bank transfer, the invoice amount must be transferred within the period specified in the order or payment information. The date on which payment is received by horntools shall be decisive.
- If the customer defaults on a due monetary claim, horntools may charge the statutory default interest of 5% per annum, unless otherwise validly agreed.
- Necessary and reasonable costs of legal action or debt collection may be charged to the customer to the extent permitted by law.
§ 7 Delivery
- Delivery is carried out by a shipping or logistics provider selected by horntools.
- The shipping conditions of horntools.ch in force at the time shall apply.
- For products in stock, the standard delivery time within Switzerland is generally 4–10 business days, unless a different delivery time is stated on the respective product page or during the ordering process.
- For pre-orders, items not in stock, custom-made products, or freight goods, different delivery times may apply. The information on the product page or the delivery information communicated individually shall be decisive.
- If a delivery is delayed for reasons beyond horntools' control, in particular due to force majeure, supply shortages, or delays on the part of transport service providers, the customer will be informed thereof as far as possible.
- For consumers, the risk of accidental loss or accidental deterioration generally passes upon handover of the goods to the customer or a recipient designated by the customer.
- For businesses, to the extent legally permissible, the risk passes upon handover of the goods to the freight forwarder, carrier, or other transport service provider.
- If packaging is visibly damaged upon delivery, we ask that, where possible, the damage be documented directly with the transport service provider and that horntools be informed promptly. Failure to report the damage to the transport service provider does not exclude the customer's statutory rights.
§ 8 Statutory Warranty and Voluntary Guarantee
1. Statutory Warranty
Defects in the delivered goods are governed by the provisions of the Swiss Code of Obligations (CO), unless otherwise validly agreed below.
Consumer claims for defects generally become time-barred two years after delivery of the goods, unless a longer period has been promised or mandatory statutory provisions stipulate otherwise.
In the event of a justified defect, horntools may in particular offer a repair or replacement delivery. Any further statutory rights of the customer remain unaffected.
2. Businesses
Businesses must inspect the goods upon receipt in the ordinary course of business and notify horntools of any recognizable defects as promptly as possible. Hidden defects must be reported immediately upon discovery.
The warranty period for businesses is, to the extent legally permissible, one year from delivery of the goods.
3. Voluntary horntools Guarantee
In addition to the statutory warranty rights, horntools grants consumers a voluntary guarantee for certain product groups:
- Roof tents: 5 years
- Roof racks: 5 years
- Winches: 5 years
- All other products: 2 years, unless a different guarantee period is specified for the respective product
The voluntary guarantee begins on the purchase date stated on the invoice. It supplements the statutory warranty rights and does not limit them.
The guarantee requires that the product be used as intended in accordance with the operating and assembly instructions, and that the prescribed maintenance and inspection intervals be observed.
4. Transferability of the Guarantee
The voluntary guarantee applies exclusively to the original purchaser and is not transferable to third parties. The statutory warranty rights remain unaffected by this.
5. Guarantee Exclusions
The voluntary guarantee excludes, in particular, damage or defects caused by:
- normal wear and tear or the natural aging of wear parts;
- improper use, overloading, or incorrect operation;
- installation or use that deviates from the assembly or operating instructions;
- unauthorized modifications, repairs, or interventions;
- the use of unsuitable accessories or spare parts, insofar as these were the cause of the damage;
- accidents, external force, lack of maintenance, or improper storage;
- natural events or other external influences not attributable to a product defect.
6. Making a Guarantee Claim
To register a guarantee or warranty claim, please contact info@horntools.com.
Please provide the order or invoice number as well as as precise a description of the defect as possible. Photos or videos can facilitate processing.
Goods should only be returned after prior coordination with horntools. The applicable return address will be communicated during processing.
A suitable proof of purchase is required as evidence of a guarantee claim. Repair or replacement does not restart the original guarantee period, unless expressly promised otherwise.
§ 9 Voluntary Right of Return for Consumers
Consumers may exercise our voluntary right of return within 14 days of receiving the goods.
The goods may generally be unpacked and inspected to the extent that would also be possible in a physical store. Any use, assembly, or commissioning beyond this may exclude the return or result in a reasonable deduction from the refund.
The customer bears the direct costs of the return.
All details of the voluntary right of return, in particular regarding deadlines, condition of the goods, original packaging, refunds, and exclusions, are set out in our Return Policy.
§ 10 Liability
- horntools is liable in accordance with mandatory statutory provisions.
- Liability for damage caused intentionally or through gross negligence cannot be excluded.
- To the extent legally permissible, horntools' liability for slight negligence as well as for indirect damage, consequential damage, lost profit, or unrealized savings is excluded. Mandatory liability provisions, in particular under the Swiss Product Liability Act, remain unaffected.
- The customer is obliged to observe the product, assembly, operating, and safety instructions and to use the product exclusively as intended.
- Information on vehicle compatibility, load capacity, assembly, or possible uses is based on the product and vehicle data available at the time. The customer is obliged to independently observe, in particular, vehicle-specific requirements, permissible roof and axle loads, as well as official regulations.
- horntools assumes no responsibility for the content of external websites linked to, insofar as no statutory liability exists.
§ 11 Packaging and Electrical and Electronic Equipment
Packaging
We ask our customers to reuse or recycle packaging material appropriately, in accordance with locally applicable requirements.
Waste Electrical and Electronic Equipment
Waste electrical and electronic equipment must not be disposed of with ordinary household waste.
To the extent horntools is obliged under Swiss regulations to take back such equipment, end consumers may return disused electrical and electronic devices of the type carried by horntools free of charge. This generally applies regardless of whether a new device is purchased at the same time.
Please contact us at info@horntools.com before returning any equipment so that we can inform you of the intended return option or return address.
Batteries and rechargeable batteries must also be returned or disposed of separately in accordance with applicable Swiss disposal regulations.
Businesses
For deliveries of goods on reusable or Euro pallets, separate arrangements may be made regarding the return or exchange of the pallets.
§ 12 Copyright
- Texts, graphics, images, videos, logos, product representations, and other content of the horntools online shop may be protected by copyright or other intellectual property rights.
- Any reproduction, editing, distribution, public communication, or other use beyond the limits permitted by law requires the prior consent of the respective rights holder.
- Product images serve to illustrate the products offered. Minor deviations of the actual product, in particular due to technical developments, production changes, or screen display, are reserved, provided they are reasonable for the customer and do not alter the essential characteristics of the product.
§ 13 Customer Reviews
- Customers can submit reviews of products purchased from horntools via our review service provider, Judge.me.
- horntools endeavors to match reviews to actual orders. This matching may take place, in particular, through an automated comparison with order data.
- horntools reserves the right not to publish reviews, or to remove them subsequently, if they contain, in particular, insulting, unlawful, obviously off-topic, or misleading content, disclose personal data of third parties, or cannot plausibly be attributed to an actual product experience.
- There is no entitlement to the publication of a review.
§ 14 Data Protection
Information on the processing of personal data can be found in our Privacy Policy.
§ 15 Final Provisions
- Contracts with horntools are generally governed by Swiss law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
- For consumers, mandatory statutory provisions for consumer protection as well as mandatory statutory places of jurisdiction remain unaffected.
- For disputes with businesses, the registered office of horntools International GmbH in Baar, Canton of Zug, Switzerland is agreed as the exclusive place of jurisdiction, to the extent legally permissible.
- For consumers, the statutory places of jurisdiction shall apply.
- Should any provision of these Terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
